Welcome to Savile Speed Co. (“Savile Speed Co.”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) apply to your access to and use of our website and any purchases made through it. By using our site, you agree to be bound by these Terms. If you do not accept these Terms, please do not use the website or make purchases through it.

1. Order Fulfillment & Shipping

Savile Speed Co. offers a curated selection of motorcycle gear and accessories. Orders are fulfilled through our distribution partners in Canada and overseas (primarily China). While we strive to maintain accurate product listings and shipping estimates, availability, pricing, and delivery times may vary.

All items purchased from Savile Speed Co. are made pursuant to a shipment contract. This means risk of loss and title pass to you upon our delivery of the goods to the shipping carrier.

Any loss, delay, or damage occurring after carrier handoff is the responsibility of the carrier and is handled in accordance with Section 5A (Damage in Transit & Shipping Claims).

 

2. Product Descriptions & Images

We strive for accuracy in all product descriptions, images, and specifications. However, we do not guarantee that content is always complete, accurate, current, or error-free. If a product received differs materially from its description or photo, your sole remedy is to return it in unused condition, subject to our Return Policy.

Colors may appear differently depending on screen settings, and sizing may vary slightly due to manufacturer differences.

 

3. Pricing & Availability

Prices are shown in CAD or USD depending on your location. Prices, promotions, and availability are subject to change at any time without notice.

The List Price represents either the manufacturer’s suggested retail price (MSRP), our estimate based on market comparisons, or the supplier’s suggested price.

In the event of a pricing error, we reserve the right to cancel or adjust orders. If the correct price is higher than what was displayed, we may contact you for confirmation or cancel your order and issue a refund.

Taxes, duties, brokerage fees, or import charges may apply depending on your shipping destination. You are responsible for any such fees not collected at checkout.

 

4. Payment & Order Processing

We accept major credit cards and secure online payments. You will not be charged until your order enters the shipping process.

Orders may be cancelled or adjusted if:

The product is out of stock

• There is a pricing or listing error

• Payment authorization fails

 

5. Returns & Refunds

Please refer to our full Return Policy for details.

You may request a return within 30 days of receiving your order. Returned items must be unused, unworn, and in original condition. Return shipping costs are the customer’s responsibility unless the item is defective or incorrect.

This Return Policy does not apply to items damaged during transportation, which are governed by Section 5A below.

 

5a. Damage in Transit & Shipping Claims

Items damaged during transportation are not considered standard returns and are handled separately due to carrier liability and product safety considerations.

Customers must notify Savile Speed Co. of any shipping-related damage within forty-eight (48) hours of delivery. Claims reported after this period may be denied.

To be eligible for review, customers must provide complete documentation, including:

• Clear photos of the outer shipping box (all sides), including any visible damage

• A photo of the shipping label clearly showing the tracking number

• Photos of the internal packaging and protective materials

• Clear photos of the product damage

• Written confirmation that the item has not been worn, installed, or used

Failure to provide complete documentation may result in denial of the claim.

For safety reasons, helmets and protective gear showing signs of impact, compression, or structural damage are considered unsafe and cannot be resold.

Once documentation is received, Savile Speed Co. will submit a damage claim to the shipping carrier. Refunds or replacements will be issued only after carrier claim confirmation, unless otherwise required by applicable consumer protection laws.

 

6. Product Use & Legal Compliance

Some motorcycle parts or accessories may be intended for off-road or track use only and may not comply with local street-use regulations. It is your responsibility to ensure all products you install or use comply with applicable local, provincial/state, and federal laws, including emissions and safety standards.

 

7. Intellectual Property

All content on the Savile Speed Co. website, including logos, designs, photos, and written content, is the property of Savile Speed Co. or its suppliers and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or exploit any content without prior written permission.

 

8. Website Use

You may use the site for personal, non-commercial purposes only. You agree not to:

• Copy, scrape, reverse-engineer, or interfere with the website

• Post or transmit unlawful, offensive, or infringing content

• Attempt to gain unauthorized access to our systems

• Use bots or automated systems to extract data

Violation of these Terms may result in termination of access and legal action.

 

9. Disclaimer of Warranties

Unless otherwise specified in writing, all products and services are provided “as is” and “as available”.

To the fullest extent permitted by law, Savile Speed Co. disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy or reliability of site content or third-party services.

 

10. Limitation of Liability

To the maximum extent allowed by law, Savile Speed Co. is not liable for any indirect, incidental, punitive, or consequential damages resulting from:

• Use or inability to use the website

• Carrier delays or failed deliveries

• Product listing inaccuracies

• Data loss or security incidents

In all cases, our liability is limited to the greater of $250 CAD/USD or the amount paid for the specific order giving rise to the claim.

 

11. Indemnification

You agree to indemnify and hold harmless Savile Speed Co., its affiliates, and service providers from any claims, damages, liabilities, or expenses (including legal fees) arising from your use of the site, breach of these Terms, or violation of third-party rights.

 

12. Privacy

13. Governing Law

These Terms are governed by the laws of the Province of British Columbia and applicable federal laws of Canada. Any disputes shall be resolved in the courts of British Columbia unless otherwise required by law.

We reserve the right to update these Terms at any time. Changes take effect immediately upon posting. Continued use of the site constitutes acceptance.

 

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
